STUDIO 1 PRODUCTIONS
ROYALTY FREE STOCK PHOTO TERMS OF USE

1) The Stock Photos are for the unlimited royalty free use of each person or company that has purchased the stock photos from Studio 1 Productions within the terms of this agreement. Studio 1 Productions does NOT transfer to you the copyright to the Stock Photos. You are free to use the photos within the terms of this agreement, but you do not acquire ownership of them.

2) The Stock Photos may be used by the purchaser or company within their own production, including film, video, DVD, educational, non-broadcast, broadcast, print, industrial, commercial or internet display.

3) The Stock Photos may NOT be resold or transferred to any other person(s) or company.

4) Under any circumstances, NO Stock Photo or Photos may be resold as an individual photo or as a whole package or as part of a stock photo package.

5) Duplication of these CD/DVDs in whole or in part is strictly prohibited and a violation of applicable laws and international copyright treaties.

6) TV stations and broadcasting companies may not supply these photos to their affiliate stations.

7) ALL Stock Photos contained on this disk MAY NOT be used in way that is defamatory, unlawful, defamatory, libelous, disparaging, misleading, untruthful, misrepresentative and/or malicious. No photo can be used in any pornographic production or in any pornographic manor.

8) The Stock Photos may not be used, in part or in whole, as a trademark or service mark, nor may you claim any proprietary rights of any sort in the Stock Photos, or any part thereof.

9) You agree to indemnify and hold harmless Studio 1 Productions, Inc. and all of its officers, directors, employees and agents ("Those Indemnified") for ANY and ALL, costs, expenses, claims, losses, damages, liabilities, claims, costs or expenses, (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) including attorneys' fees, incurred directly or indirectly by Those Indemnified in connection with the use and/or inability to use the stock photos. The buyer hereby acknowledges that Those Indemnified does not warrant, guarantee or indemnify and/or assume any liability arising out of the use any and all photos provided.

10) Studio 1 Productions makes no representation or warranty with respect to the use of names, trademarks, logos, registered or copyrighted designs or works of art depicted in any Stock Photos, and you must satisfy yourself that all necessary rights, model releases, consents or permissions as may be required for your intended usage are secured.

11) Studio 1 Productions makes no representation or warranty either express or implied including but not limited to any implied warranties of merchantability, fitness for any particular use, quality of image, or compatibility with any computer hardware or other equipment, operating system or software program.

12) THE ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE no more than the amount paid for the Studio 1 Productions Stock Photo package.

13) Studio 1 Productions stock photos are provided "as is".
