STUDIO 1 PRODUCTIONS
ROYALTY FREE MUSIC TERMS OF USE
All music from Studio 1 Productions is
copyrighted.
1) This is a non-exclusive,
non-transferable license agreement between you and Studio 1
Productions.
The Royalty Free Music (“Music”) from Studio 1 Productions is
protected by all applicable U.S. and International copyright
laws. Each person or company that has purchased the music from
Studio 1 Productions is licensed for the unlimited royalty free
use of within the terms of this agreement. Studio 1 Productions
does NOT transfer to you the ownership or copyright to the
Music. You are free to use the Music within the terms of this
agreement, but you do not acquire ownership of the Music.
2) The Music may be used by the purchaser or company within
their own production, including film, video, DVD, educational,
non-broadcast, broadcast, industrial, commercial or internet
display. Our music is considered Pod Safe. Which means it is
safe for use in Podcasts.
3) The Music may NOT be resold or transferred to any other
person(s) or company.
4) Under any circumstances, NO Music track or tracks may be
resold as an individual track or as a whole package or as part
of a music or media package. You may not sell, sublicense, loan,
give or transfer any part of the Data or a copy thereof (except
in accordance with the permitted use in a work created by you),
to another person or company.
5) Duplication of these DVDs or CD’s in whole or in part is
strictly prohibited and a violation of applicable laws and
international copy right treaties.
6) TV stations and broadcasting companies may not supply this
Music to their affiliate stations, unless it is in a production
they have created..
7) ALL Music contained on this disk MAY NOT be used in way that
is defamatory, unlawful, defamatory, libelous, disparaging,
misleading, untruthful, misrepresentative and/or malicious. No
Music can be used in any pornographic production or in any
pornographic manor.
8) The Music may not be used, in part or in whole, as a
trademark or service mark, nor may you claim any proprietary
rights of any sort in the Music, or any part thereof.
9) You agree to indemnify and hold harmless Studio 1
Productions, Inc. and all of its officers, directors, employees
and agents ("Those Indemnified") for ANY and ALL, costs,
expenses, claims, losses, damages, liabilities, claims, costs or
expenses, (including, without limitation, damages for loss of
business profits, business interruption, loss of business
information, or any other pecuniary loss) including attorneys'
fees, incurred directly or indirectly by Those Indemnified in
connection with the use and/or inability to use the Music. The
buyer hereby acknowledges that Those Indemnified does not
warrant, guarantee or indemnify and/or assume any liability
arising out of the use any and all Music provided.
10) Studio 1 Productions makes no representation or warranty
either express or implied including but not limited to any
implied warranties of merchantability, fitness for any
particular use, quality of the Music, or compatibility with any
computer hardware or other equipment, operating system or
software program.
11) THE ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL BE no
more than the amount paid for the Studio 1 Productions Music
package.
12) Studio 1 Productions Music is provided "as is" and all sales
are final. Defective disks will be replaced upon return of the
original defective disk
What Is Your Refund Policy On Music?
We have provided demos for the music online. There are NO
refunds on music (or stock footage, stock photos, software and
animations) since they can be copied to a hard drive and still
used in a production after the masters have been returned. This
is why we provide online demos. Defective items will items will
be exchanged for the EXACT same item. There are NO exceptions to
this policy.
